User Agreement

It is Appinux’s vision to create a platform where interdisciplinary collaboration, and experiences from across the country, can benefit the individual citizen as a unified effort. That’s why Appinux uses several different sites to ensure that quality and security go hand in hand.

On this page you can read about how our user agreement is and what you accept by using our platform.


1. Introduction

1.1 Contract

You agree that by clicking “Create Account” or similar, registering, signing up, accessing or using our Services (described below), you agree to enter into a legally binding contract with Appinux (even if you use our Services on behalf of a company). If you do not agree to enter into this contract (“Contract” or “User Agreement”), do not click on “Sign Up” (or similar) and do not access or otherwise use any of our services.

By using our services, you agree to all of these terms. Your use of our Services is also governed by our Cookies and Privacy Policy, which describes how we collect, use, share and store your personal information.

1.2 Changes

From time to time, we may change this contract, our Privacy Policy and our Cookie Policies. If we make significant changes, we will notify you through our services or in other ways so that you have the opportunity to review the changes before they take effect. If you do not want to accept the changes, you can close your account. Your continued use of our Services after we publish or send notice of our changes to these Terms means that you agree to the updated Terms.


2. Liabilities

2.1 Eligibility to use the service

The Services are not intended for use by anyone under 16 years of age.

To use the Services, you agree that: (1) you must be above the “minimum age” (described below) or older; (2) you may only have one Appinux account that must be in your real name; and (3) Appinux does not already restrict you from using the Services.

Members who were under this new minimum age when they began using the Services under a previous User Agreement may continue to use the Services as they have already reached the new minimum age or will reach it in the near future.

The “minimum age” is 16 years old. If the law requires you to be older in order for Appinux to legally provide the Services to you without the consent of your parents (including the use of your personal data), the minimum age will be this higher age.

Some of the promises you make to us in this agreement:
You are eligible to enter into this contract and you meet our specified “minimum age”.

2.2 Your Account

Members are account owners. You agree to: (1) attempt to select a strong and secure password; (2) keep your password secure and confidential; (3) do not transfer any part of your account (such as connections) and (4) comply with the law and conduct below. You are responsible for everything that happens through your account unless you close it or report abuse.

In the relationship between you and others (including your employer), your account belongs to you. If the Services were purchased by another party for your use, it is the party that has paid for such service that has the right to administer and receive reports of your use of such payment service, but this however, party does not have rights to your personal account.

You must keep your password secret.

You must not share an account with others and you must follow our rules and the law.

2.3 Notifications and service announcements

You agree that we may contact you in the following ways: (1) a message in the Service, or (2) a message sent to the contact information you provided (e.g., email, mobile number, physical address). You agree to keep your contact information up to date.

Review your settings to manage and limit the messages you receive from us.

You agree that we will notify you through our websites, apps and contact information that you have provided to us. If the contact information you provide is not up-to-date, you may miss important information.

2.4 Sharing

Our services provide the ability to send messages and share content in a variety of ways, e.g. your profile, presentations, news article links, job postings, InMails and blogs. Information and content that you share or post may be viewed by other members or visitors. If we have made the settings available, we respect your choices about who can see content or information (such as message content for your recipients, only sharing content with your Appinux connections, limiting your search engine profile visibility, or deselecting that we will let others know about updates to your Appinux profile).

We are under no obligation to disclose information or content in our service and we may remove it based on our sole discretion, with or without notice.

When you share information, others can view, copy and use this information.


3. Rights and restrictions

3.1 Your license for Appinux

Between you and Appinux you own the content and information you submit or post on the Services, and you only grant Appinux the following non-exclusive license: A worldwide, transferable and sublicensable right to use, copy, modify, distribute, publish and process information and content that you provide through our services without further consent, notice and / or compensation to you or others. These rights are limited in the following ways:

1. You may withdraw this license for certain Content by deleting such Content from the Services, or, generally speaking, closing your Account, except (a) to the extent that you have shared it with others as part of the Service and they has copied, reshared or saved it, and (b) for the reasonable time it takes to remove it from the backups and other systems.
2. We will ask for your consent if we want to give third parties the right to publish your posts outside of the Service. However, other members and / or visitors may access and share your content and information in accordance with your choices.
3. While we can edit and change the format of your content (such as translating it, resizing, layout or file type or removing metadata), we will not change the meaning of it.
4. Since you own your content and information and we have only a non-exclusive right to it, you may choose to make it available to others, e.g. under a Creative Commons license.

You agree that we may access, store and use any information you provide in accordance with our Privacy Policy and your choices (including settings).

By submitting suggestions or other feedback regarding our services to Appinux, you agree that Appinux may use and share (but do not need to) such feedback for any purpose without compensation to you.

You agree that you will only post content or information that does not violate the law or the rights of others (including intellectual property rights). You also accept that your profile information is truthful. Appinux may be required to remove certain information or content in certain countries.

You own all content, feedback and personal information that you provide to us, but you also give us a non-exclusive license to do so.

We will respect the choices you make regarding who can see your information and your content.

You promise that you will only provide information and content that you have the right to share and that your Appinux profile is truthful.

3.2 Service availability

We may change or close some of our services. We do not promise that we will store or continue displaying information or content that you have posted.

Appinux is not a file storage service. You agree that we have no obligation to store, maintain or provide you with a copy of any content or information that you or others disclose, except to the extent required by applicable law and as described in our Privacy Policy .

We may change, suspend or close any service or change prices at our sole discretion. To the extent permitted by law, these changes will take effect once we have notified you.

3.3 Other types of content, websites and apps

When you use our services, you may find content or information that may be inaccurate, incomplete, delayed, misleading, illegal, offensive or otherwise harmful. As a starting point, Appinux does not review content submitted by our members or others. You agree that we are not responsible for the content or information of others (including other members). We cannot always prevent this abuse of our services and you agree that we are not responsible for such abuse. You also acknowledge the risk that you or your organization may be mistakenly associated with content about others when we notify connections and followers that you or your organization has been featured in the news. You can deselect this feature.

Your use of other people’s content and information posted on our Services is at your own risk.

3.4 Limitations

Appinux reserves the right to limit your use of the Services, including the number of your connections and your ability to contact other members. Appinux reserves the right to restrict, suspend or close your account if Appinux believes that you are in breach of this contract or law or that you are abusing the Services (for example, violating our Code of Conduct).

We have the right to restrict how you can connect and communicate through our services.

3.5 Intellectual property rights

Appinux reserves all intellectual property rights in the service. Your use of the Services does not give you ownership of our services or of the content or information available through our services. Trademarks and logos used in connection with the Services are the property of their respective owners. Appinux, as well as other Appinux trademarks, service marks, graphics and logos used in connection with our services, are trademarks or registered trademarks of Appinux.

We will notify you of our intellectual property rights.


4. Disclaimer and Limitation of Liability

4.1 No guarantee

TO THE EXTENT PERMITTED BY LAW, Appinux AND ITS ASSOCIATED COMPANIES (AND THOSE WHO APPLICATE WITH US TO PROVIDE THE SERVICES) (A) DISCLAIM ANY EXTENT PERMISSIBLE WARRANTIES AND EXPRESS WARRANTIES AND EXPRESSIONS, WHETHER EXPRESSLY DISCLAIMED, EXPRESSLY DISCLAIMED, EXPRESSLY STATED. PURPOSE, ACCURACY OF DATA AND NON-INFRINGEMENT OF INTELLECTUAL RIGHTS); (B) DO NOT WARRANT THAT THE SERVICES WILL OPERATE WITHOUT INTERRUPTIONS OR ERRORS, AND (C) PROVIDE THE SERVICE (INCLUDING THE CONTENT AND INFORMATION) “AS IS AND AVAILABLE”.

SOME LAWS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OR ALL OF THESE DISCLAIMERS MAY NOT APPLY TO YOU.

This is our disclaimer of legal liability for the quality, safety or stability of our services.

4.2 Disclaimer

TO THE EXTENT PERMITTED BY LAW (AND UNLESS APPLICATIONS HAVE ENTERED A SPECIFIC WRITTEN AGREEMENT THAT IS PRIOR TO THIS CONTRACT), APPINUX AND ITS AFFILIATES ARE EXCLUSIVELY LIABLE TO OTHER BUSINESS (INCLUDING OTHER THAN APPLICATIONS) YOU OR OTHERS WITH REGARD TO ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES OR LOSS OF DATA, POSSIBILITIES, REVENUES, EARNINGS OR OTHERWISE, OTHERWISE OTHER THAN THE SERVICES (OTHER THAN THE SERVICES) OF YOUR INFORMATION OR YOUR CONTENT).

UNDER NO CIRCUMSTANCES WILL THE LIABILITY LIABLE TO APPINUX AND ITS ASSOCIATED COMPANIES (AND THOSE WHO APPINUX COOPERATES TO PROVIDE THE SERVICES EXCEEDS EVERY MORE THAN EVERY MONEY) LAST MONTHLY OR ANNUAL PRICE YOU PAID FOR ANY PREMIUM SERVICE, OR (B) $ 1000.

THIS LIMITATION OF LIABILITY IS A PART OF THE BASIS OF THE TRADE BETWEEN YOU AND APPINUX AND APPLIES TO ALL CLAIMS FOR LIABILITY (EXCL. WARRANTY, TORT, DISCLAIMER, CONTRACT, LAW, INCLUDING ALSO APPLICABLE) DAMAGE, AND EVEN THESE CORRESPONDENTS DO NOT MEET YOUR REAL PURPOSE.

SOME LAWS DO NOT ALLOW OR PARTY THE DISCLAIMER OF LIABILITY, SO THESE LIMITATIONS MAY NOT APPLY TO YOU.

Here are the limitations of legal liability we have against you.


6. Settlement of disputes

You agree that it is exclusively Danish and European law, with the exception of the conflict of laws rules that apply in any dispute relating to this contract and / or the Services.

If, in anticipation, we end up in a legal dispute, we agree to settle it in Denmark’s jurisdiction (under Danish law).


7. General terms

If a court of competent jurisdiction in this contract finds that part of it does not have legal validity, you and we may agree that the court must change the terms of granting that part of its validity while preserving its purpose. If the court cannot do this, you and we may agree to ask the court to remove the unlawful portion and still retain the remainder of this contract. To the extent permitted by law, the English version of this contract is binding and other translations serve only as an aid to users. This contract (including any additional terms that we may provide when using a feature of the Services) is the sole agreement between us regarding the Services and supersedes all prior agreements for the Services.

If we do not enforce a breach of this contract, that does not mean that Appinux has waived the right to enforce this contract. You may not disclose or transfer this contract (or your membership or use of the Services) to anyone without our consent. However, you agree that Appinux may disclose this contract to its affiliates or any party who purchases it, with or without your consent. There are no third party beneficiaries in this contract.

We reserve the right to change the terms of this contract, in which case we will notify you. We accept that any changes cannot be made retroactively. If you do not agree with these changes, stop using the Services.

You agree that the only way to notify us is through the addresses listed in Section 10.

8. Appinux’s rules of conduct

8.1 Allowed

You acknowledge that you will:

  1. Comply with all applicable laws, including and without limitation, privacy laws, intellectual property laws, anti-spam laws, export control laws, tax laws and regulatory requirements;

  2. Provide accurate information to us and keep it updated;

  3. Use your real name on your profile;

  4. Use the services in a professional way.

8.2 Not Allowed

You agree that you will not :

  1. Act in an unlawful or unprofessional manner in connection with our services, including being dishonest, abusive or discriminatory;

  2. Post inaccurate, libelous, obscene, shocking, hateful, threatening or otherwise inappropriate content or express personal criticisms or disputes;

  3. Use an image that does not look like you or is not a portrait photo on your profile;

  4. Create a false identity on Appinux. From time to time, Appinux or others with Appinux’s express consent in connection with an advertising campaign may create clearly fictitious profiles, but this does not violate this prohibition;

  5. Destroy your identity (for example, using a pseudonym), your current or past positions, qualifications, or association with a person or entity;

  6. Create a user profile for someone other than yourself (a real person);

  7. Don’t invite people you don’t know to your network.

  8. Use or try to use someone else’s account;

  9. Harass, abuse or harm others;

  10. Send or post unsolicited or unauthorized advertisements, “junk mail,” “spam,” “chain letters,” “pyramid schemes” or other similar requests that Appinux does not allow;

  11. Develop, support or use software, devices, scripts, robots, or other processes (including crawlers, browser plugins, add-ons and extensions, or any other technology or manual work) to imitate the Services or otherwise copy profiles and other data from the services;

  12. Bypass or override access controls or restrictions on the use of the Services (e.g., limited number of keyword searches);

  13. Copy, use, disclose or distribute information obtained from the Services, whether directly or through third parties (such as search engines) without the permission of Appinux;

  14. Sell email addresses or other personal information from members you do not know without their permission.

  15. Use, disclose or distribute data obtained in violation of this policy;

  16. Disclose information that you do not have the right to disclose (such as the confidential information of others (including your employer)):

  17. Violate the intellectual property rights of others, including patents, copyrights, trademarks, trade secrets, or other protected rights. For example, you must not copy or distribute (except through the available sharing feature) the posts or other content of others without their permission, which may be provided by posting the content with a Creative Commons license;

  18. Infringes Appinux’s intellectual or other rights, including without limitation, (i) copying or distributing our course videos or other material, or (ii) copying or distributing our technology unless it is released with an open source license (iii) ) use the word “Appinux” or our logos in company name, email address or URL, except as provided in the Branding Guidelines:

  19. Use Appinux invitations to send messages to people who do not know you or who are unlikely to recognize you;

  20. Post something that contains software viruses, worms, or other malicious code;

  21. Manipulate IDs to distort the origin of messages or messages sent through the Services;

  22. Create profiles or submit content promoting escort service or prostitution.

  23. Create or run pyramid schemes, scams or similar;

  24. Perform reverse engineering, decompile, disassemble, decipher or otherwise attempt to derive the source code for the Services or non-open source related technology;

  25. Indicate or declare that you are associated with or supported by Appinux without our express consent (for example, by identifying yourself as an accredited Appinux teacher);

  26. Rent, lease, borrow, trade, sell / resell access to the Services or related data;

  27. Sell, sponsor or otherwise monetize the Services without Appinux’s consent;

  28. Provide deep links to our services for purposes other than advertising your profile or group on our services without the consent of Appinux;

  29. Remove copyright, trademark or other copyright notices contained in or on our service;

  30. Use bots or other automated methods to access the Services, add or download contacts, send or redirect messages;

  31. Monitor the availability, efficiency or functionality of the services for competitive purposes;

  32. Perform “framing”, “mirroring” or any other simulation of the appearance or functionality of the Services;

  33. Overlay or otherwise alter the services or their appearance;

  34. Access the Services in ways other than through the interfaces expressly made available by Appinux, such as its mobile apps and Appinux.com;

  35. Use a service for tasks for which it is not intended;

  36. Bypass the security features of the services;

  37. Disrupt the operation of or unnecessarily burden the services, e.g. spam, DOS attacks, viruses, gaming algorithms); and / or

  38. Violate Appinux’s forum policies or any other terms for a particular service that appear when you sign up or start using the service.


9. Content complaints

We respect the intellectual property rights of others. We require that information posted by Members is accurate and does not infringe any third party’s intellectual or other rights. We have a policy and procedure for complaints about content posted by our members.
